| A special meeting of Falkirk Council is to be held on Tuesday 16 September 2025 at 1.00 p.m., the meeting having been called by the following members:- Councillors McCabe, Aitchison, Kelly, Mackie-Brown, Nimmo, Ritchie and Spears, and Baillie Kerr. In accordance with section 43 of the Local Government in Scotland Act 2003 the Provost has directed that this meeting will be conducted in such a manner as to allow remote attendance by elected members. | (a) | Health and Social Care Integration Scheme for Falkirk Integration Joint Board: Integration Scheme Review Council is asked to:- (1) note that the Integration Joint Board is empowered to direct Falkirk Council on the delivery of Council services that are deemed delegated to it through the Integration Scheme, an aspect of the governance structures imposed by the Public Bodies (Joint Working) (Scotland) Act 2014; (2) note that where delegated Council services are revised by the IJB and continue to be delivered from Council premises with Council staff, as such Council retains legitimate interests in ensuring it is aware of decisions the IJB make that impact on Council services and to make its views known as appropriate; (3) note that in instances where IJB decisions lead to the amendment or cessation of a contract between Falkirk Council and third-parties, that decision should be detailed and specifically advised to the Council; (4) acknowledge that the Council and Councillors, as the democratically accountable Local Authority and representatives, should be made aware of decisions affecting delegated Council services and impacting on other Council services & assets, with the opportunity to feedback on those proposals;? (5) agree that the annual business plan to Falkirk Council presented by the IJB Chief?Officer must contain sufficient detail to allow Councillors to understand and consider proposals that impact on Council services and that these are laid out clearly in any report submitted by council officers along with the submitted business case;? (6) recognise this opportunity for discovery and suggests dialogue on any proposals that may cause concern be communicated, through briefings or formal meetings, prior to the annual payment to the IJB in the Council budget meeting; (7) agree that in relation to points 1-6, that it falls to Falkirk Council Elected Members to consider such proposals and determine any appropriate response to the IJB; and (8) agree that the Chief Executive and the Chief Officer of the IJB consider mechanisms to be put in place, beyond the presentation of the business plan, to ensure that the Council, councillors, and ward councillors - where a proposal impacts on a facility within that ward - are informed and have an opportunity to feedback on proposals that impact on Council services and report back to Council. |
